1. RETURNS

All of our lighting is made to order, therefore they are non-refundable , we do not offer exchanges or refunds

2. WARRANTY

Anaka fixtures are warranteed for one year after receipt (not installation) against defects. Anaka will repair or replace defective components or product. Light bulbs are not covered by the warranty. Hardwired light fixtures are certified for UL for dry locations.

3. ANAKA IS NOT RESPONSIBLE FOR THE FOLLOWING

Damage caused by improper cleaning solutions or methods. Damage caused by improper installation or assembly by the customer or the customer’s agent. Damage to our fixtures, parts of our fixtures, or shades caused by the improper use of light bulbs. Damage caused by exposure to weather or improper environment. Changes in the appearance of finishes, these are meant to age in appearance. Any costs of installation, removal or re-installation.

4. VARIATIONS

Our glass is mouth-blown to order, and consequently may contain some natural variation in size, shape and colour. Air bubbles in our glass is a natural element of the mouth blowing process and is not considered a defect.  Slight variation in shape and colour is part of hand made craft and may be apparent between batches. All damage claims must be made in writing to info@atelieranaka.com within 5 working days of receipt of goods. Damage claims must include photographs along with a written description of the damage. Anaka is not responsible for repair or replacement of damages reported after this time. If damage has occurred in shipping all packaging must be retained by the receiver. Failure to do so may invalidate any claim.

5. INSTALLATION

All permanent fixtures are designed to be installed by a certified electrician. We provide installation instructions, hardware and bulbs for all pieces. Please reference your specification sheet for weight requirements. Please ensure the ceiling contains appropriate blocking. Improper installation will void the warranty.

6. LIMITATION OF LIABILITY

In no event will ANAKA be liable for special, incidental, consequential or exemplary damages arising out of this agreement or out of the use of the goods or for services provided by us, including, without limitation, damages or costs relating to the loss of profit, business, goodwill, property damage, or bodily injury, even if we are advised of the possibility of such damages, or for any similar claim against you by another party. The above exclusion of incidental and consequential damages may not be enforceable under some applicable laws, so such exclusion may not apply to you. In no case shall our liability for money damages exceed the invoice amount paid by you.

7. FORCE MAJEURE

We will not be liable for any failure or delay in performance or delivery which might be due, in whole or in part, directly or indirectly, to any contingency, delay, failure, or cause of, any nature beyond our reasonable control. Such causes include, without in any way limiting the generality of the foregoing, fire, explosion, earthquake, storm, flood or other weather, unavailability of necessary utilities or raw materials, strike, lockout, unavailability of components, activities of a combination of workmen or other labour difficulties, war, insurrection, riot, act of God or the public enemy, law, act, order, export control regulation, proclamation, decree, regulation, ordinance, or instructions of any government or other public authorities, or judgment or decree of a court of competent jurisdiction.

8. AMENDMENT

These terms and conditions may not be amended, changed or modified in any way except in written instrument duly executed by both parties.

Our lighting products are made to order for you, we do not accept returns or exchanges.

Our vases are exchangeable an item of equal value up to five days after receipt of merchandise. A 20% restocking fee is charged on all exchanges. Return shipping is at the cost of the buyer.

4. Log Files

Atelier Anaka follows a standard procedure of using log files. These files log visitors when they visit websites. All hosting companies do this and a part of hosting services’ analytics. The information collected by log files include internet protocol (IP) addresses, browser type, Internet Service Provider (ISP), date and time stamp, referring/exit pages, and possibly the number of clicks. These are not linked to any information that is personally identifiable. The purpose of the information is for analyzing trends, administering the site, tracking users’ movement on the website, and gathering demographic information.

Like any other website, Atelier Anaka uses ‘cookies’. These cookies are used to store information including visitors’ preferences, and the pages on the website that the visitor accessed or visited. The information is used to optimize the users’ experience by customizing our web page content based on visitors’ browser type and/or other information.

Atelier Anaka does not knowingly collect any Personal Identifiable Information from children under the age of 13. If you think that your child provided this kind of information on our website, we strongly encourage you to contact us immediately and we will do our best efforts to promptly remove such information from our records.
